You may not transfer your rights under these terms. We may transfer our rights where we reasonably believe your rights will not be affected.
These terms may be varied by us at any time. Such revised terms will apply from the date of publication. Users should check regularly.
These terms constitute the whole agreement and supersede all prior discussions or arrangements.
The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms.
If any provision is found invalid, illegal, or unenforceable, the rest remain in effect.
Unless otherwise agreed, no delay or omission by a party in exercising any right or remedy will be deemed a waiver.
These terms are governed by and interpreted according to the law of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English and Welsh courts.

PHOTOGRAPHY SERVICES: SPECIFIC TERMS

Bookings & Payments

Bookings must be confirmed in writing; a non-refundable deposit of 30% is required.
The remaining balance is due as specified.
Failure to pay on time may result in cancellation and withholding of images.
Prices may change; confirmed bookings are not affected by subsequent price changes.

Cancellations & Refunds

Client cancellations must be made in writing. Deposits are non-refundable.
Cancellations within 3 days of the shoot may incur further charges.
If we cancel, all monies paid will be refunded. We are not liable for other costs or losses.

Delivery of Images

Images will be delivered digitally within 2 weeks unless otherwise agreed.
Rush delivery may be available for an extra fee.
Unedited/RAW files are not provided except by special arrangement.

Digital Downloads

Digital downloads are for your personal use or as otherwise agreed in writing.
Images are supplied in high-resolution JPEG format unless otherwise specified.
Sharing, reselling, or making images available for public download is strictly prohibited.

Event Coverage & Overtime

Event coverage is for the duration agreed at booking.
If your event runs longer, additional coverage is subject to availability and charged at £100 per hour or part thereof.
You must communicate schedule changes as soon as possible. We are not responsible for missed moments due to delays, restricted access, or factors beyond our control.

Retouching Policy

Standard editing (colour, exposure, cropping, minor skin retouching) is included.
Advanced retouching (body modification, background replacement, object removal) may incur additional fees and is subject to agreement.
Unedited/RAW files are not provided except by special arrangement.

All images remain the copyright of Marbs in Frame (Marbs Media) unless otherwise agreed in writing.
Clients are granted a non-exclusive, non-transferable licence for personal use or as agreed (e.g., commercial, editorial).
Images may not be altered, resold, or shared with third parties without written permission.
We reserve the right to use images for our portfolio, website, social media, competitions, and marketing, unless you opt out in writing before the shoot.

Social Media Sharing & Credit

You may share images from your session on social media only if full and clear credit is given (e.g., "Photo by @adrian.marbs").
Images must not be posted without credit or presented as the work of another.
Editing, cropping, or applying filters that significantly alter the images is not allowed without written permission.
Use of images for commercial or paid promotions requires our prior written agreement.

Model & Client Release

By participating in a shoot, you (and all subjects, including minors with appropriate authority) consent to the use of your likeness as described, unless you opt out in writing prior to the shoot.
Model releases may be required for commercial/editorial shoots; failure to sign may restrict image use.
For minors, a parent or legal guardian must provide written consent.

Client Responsibilities

You are responsible for all permissions for shoot locations (including venue permits).
If other people are photographed (e.g., event guests), you must inform them that photography will take place.
You must provide accurate information about your event or requirements.

Prints & Products

Colours of prints/products may vary from digital previews due to different screens and print processes.
Report defective products within 30 days of receipt for a replacement or refund.
All digital product sales are final.

International Clients

Non-UK clients are responsible for any import duties, taxes, or delivery charges.
These terms are governed by English law. Disputes are subject to the exclusive jurisdiction of English and Welsh courts.

Complaints

Complaints must be made in writing within 7 days of delivery of images. We will endeavour to resolve complaints promptly and professionally.

Force Majeure

We are not liable for failure or delay in performing our obligations due to circumstances beyond our reasonable control, including (but not limited to): natural disasters, war, government actions, or failure of suppliers.

Data Protection & Privacy

Personal information is processed in accordance with our Privacy Policy and UK law (UK GDPR, DPA 2018).
